Terms of Service

This User Agreement (hereinafter referred to as the "Agreement") is an electronic contract between the User and the E-Change service and contains the rules for using the E-Change Website located at https://e-change.io/tos/ (hereinafter referred to as the "Website"). By continuing to use the Website, the User confirms their unconditional acceptance of this User Agreement.

Please note the following:
You assume all risks associated with using the Services on this Service and transacting with digital assets, currencies, and their derivatives.

You acknowledge that this Service is merely a place for you to obtain information about digital assets, find trading partners, negotiate and transact with, and transact with digital assets. You must independently and carefully determine the authenticity, legitimacy, and validity of the relevant digital assets and/or information, and you will be solely responsible for any losses arising in connection therewith.

The content of these Terms may be changed at any time without prior notice to Users. By using this Service, you agree to regularly review and monitor these Terms for update times, changes, and any modified content. If you do not agree to the relevant changes, you should immediately discontinue using the E-Change Services. Your continued use of the E-Change Services will constitute your acceptance and agreement to the updated Terms.
There are also risks associated with using an online transaction system, including, but not limited to, software, hardware, and internet connection failures. Because we do not control the reliability and availability of the internet, we are not responsible for any interruptions, delays, or connection failures.

E-Change does not act as your agent, trustee, or representative under these Terms.

1. Terms and Definitions
1.1. The E-Change Service is a platform for finding counterparties and executing over-the-counter transactions.

1.2. User — any legally competent Person who has reached the age of 18 and who has submitted an exchange request on the Website and agreed to the terms and conditions of this Agreement.

1.3. Service — facilitating P2P transactions between individuals for the exchange of cryptocurrencies, as well as other services, information about which is posted on the Service website.

1.4. Personal Data — information that identifies an individual, such as name, address, email address, bank details, and other data, in accordance with this Policy. The term "Personal Data" does not include anonymous and/or aggregated data that does not allow for the identification of a specific User.

1.5. Agreement — this User Agreement (Terms) and its integral parts, taking into account all additions and/or amendments that may be made in the manner determined by their terms.

1.6. The Website is a collection of information, text, graphic elements, designs, images, photos, videos, and other intellectual property, as well as a set of computer programs contained in the information system that make such information available at https://e-change.io/, including any subdomains. If the domain or content of the Website must be changed for any reason, it includes the Website after any such changes.

1.7. Application – a User's proposal to purchase or sell cryptocurrency using the Services provided by the Service.

1.8. Payment System – a software and hardware product developed by a third party and representing a mechanism for implementing the accounting of monetary obligations and organizing mutual settlements between its Users.

1.9. KYC & AML procedures – "Know Your Customer" (verification of the client's personal data) and "Anti-Money Laundering," which involves checking the User's digital assets/funds for anti-money laundering purposes.

1.10. Digital assets (hereinafter referred to as "cryptocurrency" or "digital currency") refer to encrypted or digital tokens or digital currencies with a defined value, based on blockchain technology and cryptography, the internal accounting units of which are maintained by a decentralized system (there is no internal or external administrator or any equivalent), operating in a fully automated mode.

2. Basic Provisions
2.1. Before using any of the Services provided by E-Change, the User must carefully read these Terms. If the User does not agree with these Terms and/or any amendments thereto, the User must immediately cease using the Services provided on the Website.

2.2. By using the Services provided by E-Change, the User represents and warrants that:

The User is at least 18 years of age. Furthermore, the User must have sufficient legal capacity to accept these Terms and enter into agreements.

Execution of contracts and transactions with digital assets through this Service;
The digital assets/funds used by the User were obtained legally;
Agrees to bear full responsibility for any possible consequences of the transactions;
Agrees to comply with applicable laws and warrants that the User's transactions do not pursue any illegal purposes.
2.3. When submitting a request for the service, the User undertakes to provide their personal bank details/crypto wallet addresses for receiving funds/digital assets under the transaction.

2.4. When making a payment under the transaction, the User undertakes to transfer funds exclusively from personal bank accounts/payment system accounts. When making a transaction with digital assets, the User guarantees that the crypto wallets/accounts on third-party centralized platforms used belong to them personally, and that third parties have no access to the User's crypto wallet/account on third-party centralized platforms. If the User suffers financial losses as a result of providing crypto wallets, bank accounts, or payment system accounts that are not their personal property, the User is fully responsible for all such losses.

3. Services
3.1. The User may order the Service and receive information about the progress of a transaction solely through the contact form with the Service representative posted on the Website.

3.2. The Service offers its services according to its established internal operating hours. The Service accepts Applications 24/7. Applications processed by the Service in semi-automated mode may take up to 24 hours to process. Applications processed manually by the Service may take up to 36 hours to process. The Service is not responsible for delays in processing applications caused by technical failures, including failures in the blockchain network.

3.3. Questions and complaints regarding applications will be accepted within 24 hours of the Application being submitted. After 24 hours, exchange requests are considered to have been properly processed.

3.4. In the event of any suspicious activity on the part of the User, or if the User uses suspicious assets, the Service may delay payment and require additional identity verification and an internal analysis of the funds used by the User.

3.5. The Service reserves the right to unilaterally refuse the Service at its sole discretion.

3.6. If suspicious activity is detected during the User's Request, the Service reserves the right to suspend such transactions until the reasons for such activity are determined to prevent damage.

3.7. If the User is sent more digital assets/money than specified in the Request, the User undertakes to immediately notify the Service. The User undertakes to return the difference in the amount of digital assets/money sent within 24 hours of receiving the funds. In the event of non-return of excess Digital Assets/funds, the Service reserves the right to restrict the provision of Services to the User and contact law enforcement agencies.

3.8. If the User has paid for an application but wishes to cancel it for any reason, the Service undertakes to ensure the return of the paid application minus bank/blockchain network fees. If the User cancels an application after payment, the Service reserves the right to withhold a 2% commission calculated from the Application amount. However, if the Application is paid for in cryptocurrency, the User assumes the risk of a decline in the exchange rate of the cryptocurrency. The User may be refunded cryptocurrency at the exchange rate (the Binance cryptocurrency exchange rate (URL: https://www.binance.com)) for a specific cryptocurrency in the amount of fiat currency based on the terms of the specific Application, at any time during the refund period. If the User wishes to cancel an Application paid for in cash, the User assumes the risk of changes in the exchange rate of the cryptocurrency. The User may receive a refund based on the exchange rate of a specific cryptocurrency (the exchange rate of the Binance cryptocurrency exchange (URL: https://www.binance.com)) based on the Request.

3.9. The Service reserves the right to cancel a Request for Services created by the User if the User has not made payment within 30 (thirty) minutes of the Request being created.

3.10. The Service does not accept funds sent via smart contracts, as it uses exchange wallets. Do not send funds directly to the Service via smart contracts, as they may be lost forever. If funds are sent via a smart contract, the User assumes all risks.

3.11. The Service reserves the right to recalculate the amount payable on the website if the exchange rate on the website changes by more than 0% between the time the Request is created and the time payment is received.

4. Rights and Obligations
4.1. If authorized law enforcement agencies receive a request regarding a User's transaction, the Service reserves the right to suspend or cancel the ongoing transaction at any time for an indefinite period. Furthermore, upon request, the Service reserves the right to provide authorized law enforcement agencies with available information about the User.

4.2. The Service reserves the right to suspend or cancel a User's transaction at any time with a refund, without regard to any losses or expenses incurred by the Service in the event of a breach of this Agreement by the User.

4.3. The Service has the right to request personal data from the User for the purpose of processing and processing the Application for the provision of Services, as well as for the purpose of sending the User information regarding the provision of Services by the Service and the consideration of the User's claims and requests. By submitting an Application on the Website, the User gives their unconditional consent to the processing of personal data.

4.4 Personal data includes:

- Last name, first name, patronymic
- Telephone number
- Email address
- Bank details (bank account number, bank card number)
- Photos/videos of the User (including photos/videos of the User holding an identity document).
- The User's passport details (or other identity document details).
- The User's blockchain wallet address

4.5. Processing of personal data means the collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, depersonalization, blocking, deletion, and destruction of personal data. The processing of the above personal data will be carried out both with and without the use of automated tools (mixed processing of personal data).

4.6. The Service reserves the right to conduct KYC and AML procedures at its sole discretion if suspicious activity is detected by the User, as well as if the Service receives a request from authorized law enforcement agencies regarding a specific Request.

4.7. When conducting AML procedures, the Service reserves the right to use specialized third-party services/programs for such checks, such as https://crystalblockchain.com/.

4.8. The Contractor reserves the right to conduct AML checks on assets received from the Client. If the acceptable risk level is exceeded (at the Service's discretion), the transaction may be blocked until the User completes verification, after which the Service may issue a refund.
Refunds are made minus the payment system's transfer fee, the network or exchange fee, and the Service's costs. Refunds may take from 1 to 30 business days.

4.9. To resolve disputes related to outgoing and incoming transactions, the Service reserves the right to request supporting documents from the client. In particular:

- a receipt/invoice (payment document);
- a bank application statement in PDF format;
- a video recording from the banking application;
- a screenshot/video recording from the personal account of the platform from which the cryptocurrency was sent;
- request the receipt of funds to the phone number provided for the transfer.

If confirmation is refused, the Service reserves the right to suspend the transaction pending clarification.

5. Force Majeure
5.1. Neither the User nor the Service shall be liable to each other for any failure to fulfill obligations related to the provision of exchange services by the Service caused by circumstances beyond the control of the parties that could not have been foreseen or avoided, including declared or actual war, civil unrest, epidemics, earthquakes, floods, fires, and other natural disasters, acts of government authorities, and other force majeure circumstances, and shall not be liable for any losses or damages arising from such circumstances.

5.2. A Party that fails to fulfill its obligation due to force majeure must notify the other Party of the impediment and its impact on fulfillment of its obligations without delay, but no later than three (3) calendar days from the occurrence of such circumstances.

5.3. A Party that fails to notify the other Party of its impossibility of fulfilling its obligations under this Agreement loses the right to rely on such impossibility.

6. Liability
6.1. The User is fully responsible for all actions related to the use of the Services, as well as for the security of their own computer systems and technical equipment.

6.2. The User acknowledges and accepts that any transaction made on the blockchain is irreversible. The User is fully responsible for providing accurate information about the recipient's wallet for the transfer of Digital Assets when using the Services, as well as for providing accurate information about the recipient's bank account details.

6.3. The User is fully responsible for using the Service.

g, the User's own actions while using the Service, the operations, transactions, and information and documentation it processes.

6.4. The Service shall not be liable in the event of blocking of the User's bank accounts/Payment System account as a result of internal checks by the aforementioned financial institutions, or if the User receives funds as a result of using the Service.

7. Final Provisions
7.1. The User shall only engage in transactions if they have a full understanding of how blockchain works and fully understand the risks associated with cryptocurrencies.

7.2. All User claims and inquiries should be sent to the Service's contact information provided on the Website. The claim review period is 7 business days from the date of receipt.

7.3. The services provided by the Service may be prohibited by law in some jurisdictions. By accepting the Service's terms of use, the User confirms that they are not a resident of such jurisdiction.

A transaction is considered complete after:
